This article reflects on the author's modest experience as an expert witness in two trials: Osheroff vs. Greenspan (1983), and In the Matter of Baby K (1994). Bioethicists' expertise as scholar-teachers and consultants on particular issues merits qualification by judges as expert witnesses. The article argues that a different kind of expertise – strong moral advocacy – is required to be an effective expert witness. The major lessons of expert witnessing for the author concern the demands and strains on the (...) bioethicist's role as scholar, teacher, and consultant. The Baby K case is analyzed in some detail, due to its importance for bioethics, ethics consultation, and the testimony of bioethicists on either side of the case. Rules of thumb are offered to guide decisions as to choices regarding expert witnessing, as well as a discussion of the interaction of law and bioethics. (shrink)

Two problems involving Thucydides and medicine have attracted intense treatment by classical scholars and medical men working separately or in combination. They are, first, the nature of the Athenian Plague which Thucydides describes and, second, the possibility of his having been influenced by the doctrines and outlook of Hippocrates and his followers. It is the purpose of the present paper to reconsider both these problems, to indicate some false assumptions made in the methodology of previous attempts to identify the Plague, (...) and to suggest a somewhat radical revaluation of Thucydides' approach to medical matters compared with that of Hippocrates. At first thought, our question of the day seems to be "about the text itself." Is there, in all texts, or at least in some texts, what Abrams calls "a core of determinate meanings," "the central core of what they [the authors] undertook to communicate"? Miller has seemed to find in the texts of Nietzsche a claim that there is not, that "the same text authorizes innumerable interpretations: There is no 'correct' interpretation. . . . reading is never the objective (...) identifying of a sense but the importation of meaning into a text which has no meaning 'in itself.'" Abrams claims that Miller cannot report on Nietzsche's deconstructionist claims without violating them: Miller seems to claim that he has found something that Nietzsche's text really says, not something that Miller himself merely brought to it. Cebes has heard the Pythagorean Philolaus, among others, saying that suicide was immoral, but has gathered no satisfactory explanation as to why this should be so. One reason, impressive, but, Socrates admits, difficult is to be found.

Napolitano (The epistemology of fake news, Oxford University Press, 2021) argues that the Minimalist Account of conspiracy theories—i.e., which defines conspiracy theories as explanations, or theories, about conspiracies—should be rejected. Instead, she proposes to define conspiracy theories as a certain kind of belief—i.e., an evidentially self-insulated belief in a conspiracy. Napolitano argues that her account should be favored over the Minimalist Account based on two considerations: ordinary language intuitions and theoretical fruitfulness. I show how Napolitano’s account fails its own purposes (...) with respect to these two considerations and so should not be favored over the Minimalist Account. Furthermore, I propose that the Minimalist Account is the best conception of ‘conspiracy theory’ if we share Napolitano’s goal of advancing the understanding of conspiracy theories. (shrink)

Since the publication of our article on Thucydides and the Plague of Athens, Dr Heinrich von Staden of Yale University has kindly drawn our attention to a paper by Eby and Evjen suggesting that the Plague was glanders. We do not think that this diagnosis can possibly be correct, though there are undoubtedly some points in its favour. The authors have argued their case as persuasively as possible, and the proposal has sufficient merit to deserve a serious reply.

At the Seventh Congress of German Historians held at Heidelberg in April, 1903, Prof. Eduard Meyer delivered an address on the subject of Augustus, in which he expressed his view that the restitution of the republic was a genuine act of renunciation. ‘Augustus desired to dwell among his fellow-citizens not as a ruler but as a citizen, of course as the first among them all, as the princeps, like Camillus and the Scipios of old.’ If with Mommsen you described the (...) dual control of Caesar and Senate as a Dyarchy you ought not to forget that’ of the two the Senate in theory held complete predominance,1 the Emperor was ‘its executive, or as Tiberius expressed it, its servant, the Senate was the master .’. In lieu of an abstract, here is a brief excerpt of the content:AN EARLY ACCOUNT OF DAVID HUME In New Letters of David Hume, Professor Klibansky and Mossner lamented the "dearth of information on Hume's early development". Though some new facts and documents have emerged since 1954, the early period of Hume's life, to 1740, remains the most obscure. The account of Hume in 1740 presented below adds nothing to our knowledge of the evolution of Hume's philosophy, but it does (...) give us an interesting picture of the young philosopher in society, and it suggests that those traits of character which later earned him the title of "le bon David" were already in evidence. The sketch below stresses, as many of his friends and adversaries were later to do, the divergence between the detached scepticism of his writings and his amiable engagement in the social life of a company. And if we take seriously the report that Hume was left in charge of the domestic "oeconomy" in the family he was visiting at Richmond, we might see this as foreshadowing his solicitude over, and constant interest in, the management of his own household and financial affairs in later years. The account printed here is an extract from a letter by William Mure of Caldwell to his sister Agnes, 2 dated "Richmond June 5th 1740". Mure has long been recognized as one of Hume's most intimate friends: Hume himself summed up the relationship when he wrote, on Mure' s death in 1776, "The Baron was among the oldest and best Friends I had 3 in the World." The document published here constitutes the earliest concrete evidence of their friendship yet recovered, ante-dating Hume's first published letter to Mure by more than two years. It appears that the two men were spending the summer of 17 40 in or near London, and possibly both staying at the house of some mutual friend. Mure had at this time just finished his study of law at Edinburgh University, and would probably have been vacationing in 79 London eri route to Leyden, where he was to complete his legal training. Hume may have been in the capital preparing to see Book III of his A Treatise of Human Nature, "Of Morals", through the press: it was published in November 1740. This, and the first two books of the Treatise, which had been published in 1739, were presumably the writings which he discussed with the company at Richmond. We have been here now these ten days, and pass our time in a very agreeable way, we have our aountrey man Mr. Hume the author of the Metaphysical books 7 that you heard so much of last summer as a party in our retirement, he is a very sensible young fellow and extreamly curious in most parts of learning and how much soever he has shown himself a Sceptick upon subjects of speculation and enquiry, he is as far from it as any man with regard to the qualities of a well natured friendly disposition, and an honest heart which are no doubt of greater consequence to the intrinsick worth of a character than any abstract opinions whatever. As he is very communicative of all his knowledge we have a great deal from him in the way of dispute and argument, and not a little too in the way of plain information we reason upon every point with the greatest freedom, even his own books, (which we are working at at present) we canvass with ease, and attack him boldly whereever we can get the least hold of him, and question or contradict his most favourite notions; all this goes on with thè greatest good humour, and affords us entertainment both within doors, and in the feilds at our walks in this delightful country, which is the finest that one can possibly imagine, and has the preference by people that has travel'd throw most of Europe, to any they ever saw. Professor Cohen makes extensive reference to a lecture “Hypotheses relating to the brain-mind problem” which was published in Nature. He gives a succinct account of the suggestions that I put forward, and then goes on to state that they “illustrate two fallacies which are to be found in so many contributions to the study of the body-mind relationship.” Be that as it may, but Professor Cohen has chosen most unsuitable illustrations, for in both cases they are based on misunderstandings of (...) my article. The quality of the consent obtained from 41 volunteer subjects in eight experiments is evaluated. Five subjects (all physicians) gave informed consent; 22 subjects gave partially informed consent; and 14 subjects merely gave consent. It is argued that 'informed' consent is obtainable only from medically trained people, and that lip service to this concept in laymen should cease. The concept of medical competence should instead be introduced and a personal medical referee appointed to adjudicate on behalf of the volunteer.
